GENERAL CONDITIONS OF SALE

ART. 1 – ACCEPTANCE OF THE GENERAL CONDITIONS OF SALE AND CONCLUSION OF THE CONTRACT

The contract stipulated between Dadart and the Customer must be considered concluded with the acceptance, even if only partial, of the order by Dadart. In the event of non-acceptance of the order, Dadart will in any case promptly notify the Customer.

By placing an order in the various ways provided, according to the order form on the Site (hereinafter the "Order"), the Customer declares to have read all the information provided to him during the purchase procedure and to fully accept these general conditions (hereinafter the “Conditions”).

These Conditions may be printed or saved on a durable medium, in compliance with the provisions of the art. 12 of Legislative Decree 70/2003 and art. 51 of Legislative Decree 206/2005, as amended by Legislative Decree 21/2014.

ART. 2 – PURCHASE METHODS

The products offered for sale are only those present on the dadart.it website at the time the Order is placed, as described in the relevant information sheets.

Once the order request has been received, Dadart reserves the right to reconfirm the availability of the purchased items, the validity of the credit card transaction and to verify the details of previous transactions carried out by the Customer on DadArt.it

In the event that the ordered items are not available, or if for some reason the order cannot be processed as per the Customer's request, Dadart will promptly notify the Customer.

In any case, it is understood that the images accompanying the description of a product are for informational purposes only and may not be perfectly representative of its characteristics but may differ, for example. by color and size (also based on the browser and monitor used to access the Site and view the images).

To place an Order, the Customer must complete the relevant form on the Site in its entirety and send it after having carefully read the Conditions, as well as the characteristics of the product and/or products he intends to purchase. The Customer must also request, where desired, the issuing of a tax invoice relating to the purchase, pursuant to art. 22 Presidential Decree no. 633/1972.

In this case the customer will automatically lose the right of withdrawal and the right to the guarantee, as provided for by the consumer code, will be limited to twelve months from the date of purchase of the product.

The correct receipt of the Order is confirmed by DadArt through a response via e-mail, sent to the e-mail address communicated by the Customer. This confirmation message will summarize the purchase conditions, as required by applicable law, as well as the data entered in the Order by the Customer, so that the Customer can verify the same and possibly communicate the necessary corrections of incorrect data without delay.

ART. 3 – PRICES AND PAYMENT METHODS

The prices indicated on the site are to be considered inclusive of taxes and duties foreseen in the country of invoicing. Any shipping costs or payment costs are in any case communicated in advance to the Customer through the site or these Conditions. Please note that it is possible to indicate separate shipping and billing addresses as long as they are within the same country. All orders violating this condition will be cancelled.

The prices indicated on the site are expressed in Euros. If the conversion into currencies other than the euro is indicated, it will be purely indicative and not binding for the conclusion of the purchase contract.

The following payment methods are available:

  • PayPal
    For payment, the customer can use the Paypal circuit according to its specific methods
  • Credit card
    In cases of purchasing goods with credit card payment method, the transaction will take place through the secure Paypal server. In no case and at no stage of the payment will DadArt be able to know the information relating to the Customer's credit card, transmitted via a protected connection directly to the website of the banking institution that manages the transaction. No DadArt computer archive will retain such data and therefore in no case DadArt can be held responsible for any fraudulent or improper use of credit cards by third parties at the time of payment

ART. 4 – PRIVACY

The personal data collected when placing the Order will be processed by Dadart.it for the sole purpose of satisfying the express requests of the Customer, in compliance with Legislative Decree 196/2003 and the privacy information on the site. Any further processing will be carried out only with the express consent of the Customer.

ART. 5 – APPLICABLE LAW

The sales contract referred to in these Conditions and its execution is governed by Italian law, with the non-application of conflict rules and the United Nations Convention for the International Sale of Goods. The exclusive jurisdiction and venue for any legal action brought by the Buyer pursuant to this guarantee or any further legal guarantees will be the Court of Patti.

ART. 6 – RIGHT OF WITHDRAWAL

The consumer has the right to exercise the right of withdrawal. In particular, the consumer has the right to withdraw from any contract concluded with DadArt, without any penalty and without specifying the reason, within 14 (fourteen) working days from receipt of the goods.
The right of withdrawal is recognized by the consumer in relation to any goods purchased by him on the website www.dadart.it.

ART. 7 – METHOD FOR EXERCISING THE RIGHT OF WITHDRAWAL

The right of withdrawal is exercised by simple communication by the customer to the email address [email protected], or other means of communication such as chat on the site or WhatsApp Business.

If the goods have been delivered, the customer is required to return them to DadArt.it within 15 (fifteen) working days from the date of delivery of the goods.
The good must be returned complete with all accessories, instruction manuals and everything originally delivered to the customer, as well as packaged in its original packaging. A copy of the electronic order receipt must be attached to the returned product. The costs of returning the goods are borne by the customer.
If the right of withdrawal is exercised by the customer in accordance with the provisions contained in this clause, Dadart.it is required to refund the sums paid by the customer.
DadArt.it has the right to reject any product returned in ways other than those specified above, or if the methods and times indicated for communicating the exercise of the right of withdrawal have not been respected.

ART. 8 – AGREEMENT

The contract replaces all previous contracts, agreements and understandings between the parties and constitutes the entire agreement between the parties regarding the subject matter of the contract, together with the order, the general conditions relating to the use of the site and the conditions relating to the registration service. Any variation or modification of the contract must be accepted in writing by both parties.

ART. 7 – COMMUNICATIONS

All communications between the parties must be made in writing and sent to the other party's address indicated in the contract and in the order. Communications sent to the other party's email address, indicated on the site and in the order, are also considered to be sent in writing.

Communications relating to the validity or existence of this agreement must be exclusively delivered by hand or sent by registered letter with acknowledgment of receipt.

ART 8 – PURCHASE REQUIREMENTS

To complete a purchase on the DadArt website, the Customer must satisfy the following requirements:

  • Be at least 18 years old.
  • Possess the necessary requirements to be able to enter into legally binding contracts.
  • Have a valid email address.
